Please read these Terms and Conditions carefully before using the PullVault platform, including our website at www.pullvault.app, our web application, and any associated mobile applications (collectively, the "Platform"). These Terms constitute a legally binding agreement between you and PullVault.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.
PullVault is operated by PullVault, a business based in Sydney, New South Wales, Australia ("we", "us", "our").
1.
Eligibility and account registration
- ▸1.1 You must be at least 13 years of age to use the Platform. If you are under 18, you must have the consent of a parent or legal guardian.
- ▸1.2 You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- ▸1.3 You must notify us immediately at hello@pullvault.app if you suspect any unauthorised use of your account.
- ▸1.4 We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including for violations of these Terms.
2.
Description of services
PullVault provides an AI-powered platform for scanning, identifying, cataloguing, and tracking Pokémon trading cards and other collectible trading cards (Services). The Platform includes:
- ▸AI-powered card scanning and identification using image recognition technology
- ▸Collection management and tracking tools
- ▸Market value estimates and pricing information
- ▸Condition grading assessments
- ▸Wishlist and collection sharing features
- ▸CSV import and export functionality
- ▸Analytics and statistics dashboards
The Services are provided for personal, non-commercial use unless you have entered into a separate commercial agreement with us.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable.
3.
Subscription plans and payments
- 3.2All prices are displayed and charged in Australian Dollars (AUD). Payments are processed by Stripe and your bank statement will show the charge in AUD.
- 3.3Subscription fees are billed in advance on a recurring basis. Your subscription will automatically renew unless cancelled before the renewal date.
- 3.4You may cancel your subscription at any time through your account settings or by contacting us at hello@pullvault.app. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partially used billing periods unless required by applicable law.
- 3.5We reserve the right to change our pricing with at least 30 days written notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
- 3.6Payments are processed securely by Stripe. We do not store your full payment card details.
- 3.7If a payment fails, we may suspend your access to Pro features until payment is resolved.
- 3.8Where applicable under Australian law, GST may be included in the displayed price. A tax invoice is available upon request.
Plans
- ▸Free Plan: Limited to 10 card scans per month and up to 50 cards in your collection.
- ▸Pro Trial: Full Pro access for 14 days at no cost. No credit card required to start.
- ▸Pro Monthly: Unlimited scans, unlimited collection size, live market pricing, wishlist, public profile, CSV import/export, and all premium features. Billed at AUD $7.95 per month.
- ▸Pro Yearly: All Pro features billed annually at AUD $54.95 per year (saving over 40% compared to monthly billing).
4.
Australian Consumer Law
- 4.1Nothing in these Terms excludes, restricts, or modifies any right or remedy implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited.
- 4.2Where we are permitted to limit our liability for a failure to comply with a consumer guarantee, our liability is limited to re-supply of the services or payment of the cost of having the services supplied again.
- 4.3If you have a complaint, you may contact NSW Fair Trading at www.fairtrading.nsw.gov.au or the ACCC at www.accc.gov.au.
5.
Intellectual property
- 5.1The Platform, including all software, design, text, graphics, logos, and content created by PullVault, is owned by or licensed to us and is protected by Australian and international intellectual property laws.
- 5.2We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal use in accordance with these Terms.
- 5.3You must not copy, modify, distribute, sell, lease, reverse engineer, or use the Platform to build a competing product or service.
- 5.4Pokémon and all related names, characters, and indicia are trademarks of Nintendo, Creatures Inc., and GAME FREAK Inc. PullVault is an independent platform and is not affiliated with, endorsed by, or sponsored by The Pokémon Company or Nintendo.
6.
User content
- 6.1You retain ownership of any content you upload to the Platform, including card images and collection data.
- 6.2By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, process, and display that content solely for the purpose of providing the Services to you.
- 6.3You warrant that your content does not infringe any third-party rights and does not contain any illegal, harmful, or offensive material.
7.
Prohibited conduct
You must not use the Platform to violate any law, engage in fraudulent conduct, impersonate others, upload malicious code, attempt unauthorised access, scrape data, use automated tools, interfere with Platform performance, harass other users, or use the Platform for commercial purposes without our written consent.
8.
AI-generated content and accuracy disclaimer
- 8.1The Platform uses artificial intelligence to identify cards, assess condition, and estimate market values. These assessments are provided for informational purposes only and may not always be accurate.
- 8.2Market value estimates do not constitute financial advice, a guarantee of resale value, or a professional appraisal. For high-value cards, we recommend seeking professional grading services such as PSA, BGS, or CGC.
- 8.3We are not liable for any loss or damage arising from your reliance on AI-generated content.
9.
Privacy and data protection
We collect and handle your personal information in accordance with our Privacy Policy and in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.
10.
Third-party services
The Platform integrates with Anthropic (AI analysis), Supabase (database), Stripe (payments), Vercel (hosting), and TCGPlayer/Pokemon TCG API (pricing data). Your use of these services is subject to their respective terms and privacy policies.
11.
Limitation of liability
- 11.1To the maximum extent permitted by law, we exclude all liability for any direct, indirect, incidental, special, or consequential loss arising out of your use of the Platform.
- 11.2Where our liability cannot be fully excluded, our total aggregate liability is limited to the amount you have paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.
- 11.3Nothing in these Terms limits our liability for fraud, death, or personal injury caused by our negligence.
12.
Indemnification
You agree to indemnify and hold harmless PullVault and its officers, employees, and agents from any claims, liabilities, damages, and expenses arising out of your use of the Platform, your violation of these Terms, your User Content, or your violation of any third-party rights.
13.
Termination
Either party may terminate your account at any time. We may suspend or terminate immediately for breach of these Terms. Upon termination, your right to use the Platform ceases. We may delete your account data after a reasonable period, except where required to retain it by law.
14.
Dispute resolution
If you have a complaint, contact us first at hello@pullvault.app. We will attempt to resolve disputes informally within 30 days. If unresolved, both parties agree to attempt mediation through the Australian Disputes Centre before commencing legal proceedings.
15.
Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
16.
General provisions
These Terms constitute the entire agreement between you and PullVault. If any provision is found invalid, the remaining provisions continue in full force. We may update these Terms with 14 days notice. Continued use after the effective date constitutes acceptance.
